Private Property Impacts and Information

MTA's development of the Second Avenue Subway, a project that will benefit the public as a whole, will require the purchase of specific private property within the project area. The property requirements of the project are listed in Chapter 8 of the Final Environmental Impact Statement. However, some changes in property requirements have been made since the publication of the FEIS. Public Hearings under Article 2 of the New York State Eminent Domain Procedure Law were held on June 14, 2006, April 30, 2007, and September 20, 2007.

The purchase of private property is primarily governed by the federal "Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970," (Uniform Act) because a federal grant will pay for the construction of the Second Avenue Subway. The Uniform Act provides important protections and assistance for people affected by Federally funded projects. This law was enacted by Congress to ensure that people whose real property is acquired, or who move as a result of projects receiving Federal funds, will be treated fairly and equitably and will receive assistance in moving from the property they occupy.
