Environmental and Regulatory Process

The Fulton Street Transit Center project has been conducted pursuant to the requirements of the National Environmental Policy Act of 1969 (NEPA). Specifically, the DEIS and FEIS were prepared in accordance with regulations for implementing NEPA as issued by FTA (49 CFR part 622 and 23 CFR part 771) in conformance with the regulations of the Council on Environmental Quality (CEQ) (40 CFR parts 1500 - 1508). This project also complies with the requirements of Section 106 of the National Historic Preservation Act of 1966, as amended, Section 4(f) of the U.S. Department of Transportation Act of 1966, the Clean Air Act Amendments of 1990 and other applicable statutes, rules and regulations.

Environmental Impact Statement

A Draft Environmental Impact Statement for the Fulton Street Transit Center project was issued for public review on May 5, 2004. A Public Hearing was held on June 8, 2004. The Final Environmental Impact Statement was issued on September 29, 2004. A Record of Decision was issued by the Federal Transit Administration on November 22, 2004.

Historic Preservation

A significant historic site is identified as a historic resource that is either on or eligible for listing on the National Register of Historic Places, as defined in 23 C.F.R. Part 771.135, and through consultation with the New York State Office of Parks, Recreation and Historic Preservation (NYSOPRHP) and appropriate local officials. Documentation of this consultation is contained in Appendix H of the FEIS. The New York City Landmarks Preservation Commission (LPC) is a consulting party in the Section 106 review of the FSTC and is also a participant in the Technical Advisory Committee (TAC) for the project.
